2. ENTRY REQUIREMENTS: Go to http://kokospetspa.com/gallery, and submit your photo as directed. This is an Internet-only Giveaway. The Giveaway program begins on 11/26/08 at 12:01 AM (EST) and ends at 11:59 PM (EST) on 1/1/08. Sponsor has the sole discretion to determine the valid and official entry time should any discrepancies of time occur. Additionally, Sponsor reserves, in their sole discretion, the right to extend or de-extend the Giveaway Period for whatever reason without notification. Limit one entry per person. Odds of winning depend on number of votes and views cast. Voting for the photos is allowed one time per person per IP address. Registered and non-registered persons are able to vote.

3. ENTRY CONDITIONS: By entering, entrant agrees: (a) To abide by these Contest rules (exact compliance is essential); (b) To accept as final and binding the decisions of the Sponsor(s) and their agents in all matters relating to this Contest; (c) That Sponsor will be allowed to utilize all entries submitted in promotion of Contest event; and (d) That all entries will not be returned.

4. VOTING: Three (3) photo winners will be selected by public voters at the end of the voting period. One Zoomie Award will be selected by the staff of KoKosPetSpa at the end of the contest period. Voting and selection decisions are final and binding in all matters. Winners will be notified by email. Winners may not substitute, assign, or transfer prize or redeem prize for cash. Sponsor reserves right to substitute prizes without notification.

In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the email address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The potential Winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.

5. PRIZES: The following prizes will be awarded: One first (1st) place prize for the photo with the most votes & views. One second (2nd) place prize will be awarded to the entry receiving the second highest number of votes & views. A third (3rd) place prize will be awarded to the entry with the third highest number of votes & views. And a special Zoomie Prize for the video selected by the staff of KoKosPetSpa. Each prize package will contain an item(s) provided as outlined on the Contest page. Items included in the prize packages may be subject to change. Contribution or donation portions of the prize packages will be recommended by the appropriate winner and verified by KoKosPetSpa. Organizations must be non-profit 501(c)3 pet shelter or rescue organizations that help homeless pets find new homes. Contributions will be made directly to the approved shelter/rescue organization. Winners will be deemed the subscriber to the Internet account, who must comply with all of these rules. Prize won by a minor may be awarded to parent/legal guardian. Limit of one (1) prize per person/household.

6. ELIGIBILITY: Contest is subject to all U.S. federal, state and local laws and regulations and is void where prohibited, taxed or restricted by law. To be eligible to win a prize, entries must be completed and received by Sponsor in compliance with these rules and all other instructions of Sponsor’s. Contest is open to legal residents age 18 or older of the contiguous 48 United States. Employees of Sponsor and their affiliates, subsidiaries, distributors, retailers and anyone involved with the design, production, execution or distribution of Sponsor' products or related promotional materials and their families are not eligible. Limit one entry per person. No other entries will be accepted.

GENERAL: Prize Winners will be notified by email approximately 15 days after selected. If prize notification or prize is returned as non-deliverable, prize will be forfeited and no alternate Winner selected. Unclaimed prizes may not be awarded. If an individual winner does not claim his or her prize by February 1, 2009, the prize will be forfeited back to the sponsor or given to the person with the submitted photo having the next highest number of votes and views. Prizes cannot be claimed after the Contest has been completed or forfeited. Neither the Sponsor nor any of their agencies are responsible for lost, interrupted, or unavailable network server or other connections, miscommunications, failed telephone or computer transmissions, or technical failure, jumbled, scrambled or misdirected transmissions, or other errors of any kind whether human, mechanical or electronic or for phone, electrical, network, computer hardware or software program malfunctions, failures or difficulties, or for ISP/network/Web site accessibility or unavailability. Persons found tampering with or abusing any aspect of this Contest, as solely determined by the Sponsor, will be disqualified. If disqualified for any tampering or abuses, Sponsor reserves the right to terminate entrant's eligibility to participate in Contest. In the event any portion of this Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor which, in the sole opinion of the Sponsor, corrupts, or impairs the administration, security, fairness or proper submission of entries, Sponsor reserve the right at their sole discretion to suspend or terminate the Internet Contest, and randomly select a Winner(s) from Internet entries received prior to the action taken. All decisions of Sponsor on all matters relating to this promotion are final.

7. GENERAL RELEASE: WINNER BY ACCEPTANCE OF PRIZE(S) AGREES THAT SPONSOR AND THEIR AFFILIATE COMPANIES, AND THE IDENTIFIED CORPORATE PROVIDERS OF THE INDIVIDUAL PRIZES FOR THE GIVEAWAYS AND THEIR, PARENTS, SUBSIDIARIES, ADVERTISING AND PROMOTION AGENCIES, AND ALL OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY WINNER AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS OR PETS, INCLUDING DEATH OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF THE PRIZE OR PARTICIPATION IN THIS GIVEAWAYOR PARTICIPATION IN ANY GIVEAWAY RELATED ACTIVITY.

IF WINNER IS A MINOR, WINNER'S PARENTS OR LEGAL GUARDIANS FURTHER AGREE TO INDEMNIFY EACH OF THE RELEASED PARTIES FROM ANY CLAIMS, COSTS, INJURIES, LOSSES, OR DAMAGES DESCRIBED IN THE PRECEDING PARAGRAPH WHICH MAY BE SUFFERED BY THE UNDERAGED WINNER.

8. USE OF WINNER'S NAME, LIKENESS, Etc.: Except where legally prohibited, Winner grants permission for Sponsor and those acting under their authority to use his/her name, photograph, voice and/or likeness, for advertising and/or publicity purposes without consent or additional compensation.

9. WINNER'S RESPONSIBILITY: ALL FEDERAL, STATE, AND LOCAL TAXES, LICENSE, TITLE AND/OR REGISTRATION FEES OR OTHERS COSTS, ASSOCIATED WITH WINNING THE PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNER. SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY SUCH TAXES, FEES AND COSTS.
